Unity is Strength Good People……

My Dear Loving Good People of Kenya, where is our Love for Unity we had enjoyed in the past ??? Someone selfish and greedy stole it from us and locked it away hiding it in the undercover closet. It is our duty and responsibility to find it urgently and speedily by all means because it is delicate and we cannot do without it; it is our livelihood an survival kit for Good Governance with just Rule of Law and we own it; it belongs to us collectively for sharing and not a dispense in the authority of an individual of a Tribal cocoon…….!!! If the closet is locked by a Tribal Padlock, we must unlock the padlock using the key of a United Kenyan Peoples Power…….We must reject Tribal cocoon of selfish hypocrisy !!! Wake Up People !!!

Why should the Bomas of Kenya be blocked inaccessible for Public when public business is supposed to be transparent and rigging is not up Kibaki's sleeves. Where Public business is engagedWhat is Kibaki trying to hide where he does not want people to witness? If it is Free and Fair, what is he hiding??? Why send threats and intimidation on Chief Justice Mutunga??? People, this Kibaki has made it quite clear that rigging is in full-scale recent outbursts of his PS Kimemia with his Police Agents and this calls for people to put the right gear for a good fight in order to confront Kibaki squarely if Kibaki thinks Kenya belongs to him. These are panic attacks forming butterfly in Kibaki's stomach and flash-backs of 2007/8 is beging to make reality in his mind. This shows that Kibaki is going to make many more mistakes before March 4th 2013. Although knowing what it is, election process is already flawed and elections need to be halted. Let people show Kibaki that Kenya belong to Kenyans and not to a cocoon of tribal outfit………We will fight for Kenya in all fronts anyway anyhow and the will of people shall prevail. Like Achuth, the scavenger bird, we shall remain vigil, very vocal and all macho ready for any misharps and the world too is watching…….Bomas of Kenya MUST remain public place and Transparent……No Rigging and Integrity examination test must be done before election date. This is a must……Chief Justice Mutunga is the head of an Independent Government Organ who according to the Reform order for Transitioning, should be the Chair of the Transitioning Team. These threats of Intimidation on Chief Justice Mutunga must not be taken lightly and we demand all good people, friends and sympathizers to join all of us on this until Integrity examination is made a reality............How can the corrupt have their cake and eat it at the same time???? How can that be????

I am not going to give up on Kenya. I know Kenyans people strengths and abilities. I know you are not cowards. I know you are educated, learned and informed. I know that you love peace and unity for common good of all and cannot be taken for fools anymore to be used as rugs and be dumped by corrupt politicians after use; who do not care, value or honor humanity and have no human empathy or dignity. I know that you know your legal and human rights and will follow the advice of your Big Brother. I want you to know that he loves you very dearly; that deep down in his heart, he cares for all of us in a honorable dignified manner as a people that he shares and feels for their pain which otherwise, he would not have sent Kenyans greetings with good tiding message of wisdom for hope. Trust and Believe that there is hope at the end of the tunnel only if Kenyans people are able to make sensible wise choices without wasting people's power in unity to do right. If you do that, Big Brother will not leave you alone but stick and stay with you down the way. It is because he hates corruption with impunity. He knows the price of Corruption and Impunity that it destroys livelihood and survival and no progressive success can be achieved where corruption is tall order like it is in Kenya. Corruption is destroying the world and we can see what it has done in Economic Crisis collapse that has been created by the beneficiaries in the World Bank in conjunction with International Corporate Special Business Interest conspiracy. People, this behavior is perpetuated by selfish greed who don't care about the rest of International Human Rights Treaty ……. they don't understand that, without peace there is no unity and without unity there is no balance to face real challenges of competition for progressive development and therefore, there shall be no trust in Mutual sharing for common good of all……….and people shall continually live under oppression in continued fear of intimidation without real true freedom………Let our struggle bear reality of meaning in this Reform Change to improve our destiny so we are able to leave this world better than we found it……..

You have eyes but you do not see, you have ears but you do not hear, you are Blessed with Big Brother but you seem not to take notice or care; where is your logics? Wisdom is calling on the streets and in the highways, don't let your Blessings pass you. God has many good things in store for Kenyans and the whole of Africa with the rest of the world. The time is now; times such as these are rare and by the step of faith, take advantage of the situation and save yourselves from 50 years of the oppressive bondage of bad leadership; leadership full of corruption and impunity, leadership of Land Grabbing; leadership of selfishness and greed; leadership of segregation and stealing from taxpayers taking public finances, utilities and facilities with public business corporations and forcefully engage in stealing cows, and land from unsuspecting victims including agricultural produce with the help of Civil Servants in the Police force aided by Local Chiefs; leaving culprits to succumb into extreme poverty driven into hopelessness and homelessness just for the sake to enrich. This is doom and is unacceptable. It is for this reason that you must heed and listen to words of wise men and women and you will not go wrong. I am calling on all people of Kenya and the whole of Africa; that this is our time to open our eyes and see light and never allow ourselves to be fooled. It is time to say NO to those who have engaged in making your lives miserable because your lives are honorable and dignified; that you were created for better things and be happy enjoying your gifts from God and not being miserable and sad. You were created to benefit from God's promises upon His creation and in caring and sharing we were made to enjoy ourselves through socializing in Love united under peace and not being victims of slaughter being butchered carelessly like someone own your life; constantly living under fear of being massacred and assassinated without legal justice protection; how can that be and why should we allow to be used like worthless things used by Special Business Interest network who under Prejudice of Political Conspiracy use our support to stay and remain in power engaging in THIEVING and later dump us in the dustbin for waste after they have gained what they want. Shouldn't you be a little cleaver this time round my loving good people…!!! Kenyans are such a wonderful, social, peaceful and loving people and it was not by chance that God made you this way; you are the salt of the earth and a show-case for the rest of Africa; why are you allowing yourselves to be wasted and forced into behaving like beggars and beasts of the wild jungle? You can do better good people, you can do better and join hand this last minutes to reject bad leadership through People Power……….

It is not a secret and you all know that the Reform Change Accord was scuttled by the same unscrupulous corrupt political engineering who sneaked flawed policies to serve special business interest against public mandate; and we all know that after they created loophole windows for escape denting the Reform Accord Mandate, the corrupt expect to regain power to continue with their 50 year chain scheme of corruption and impunity (business as usual) where, at the Ministry of Transport notably the Kenya Ports Authority and the Kenya Airways, Mr. Kimunya employed his tribesmen of Kikuyu from top Management to bottom without providing ethical balance and this cannot go without question; Uhuru Kenyatta in his Finance Ministry run the Ministry's affairs as private family affair and he cannot be allowed to vie before Transparency and Accountability to ascertain checks and balances of fiscal debt responsibilities he incurred in the irregular Financial Budgeting and Expenditures that will bear heavy burden on Public-Taxes in ways and means paying for high-cost priced consumer basic needs to redeem suspicious and unscrupulous stolen funds that are the reason why poverty with unemployment is unprecedently growing at an alarming rate and our lives are made more miserable. Look at the Ministry of Energy and Natural Resources, who is fooling who??? Land Grabbers must sort their problems in court before they can think of holding public offices. How can 4000 acres land stolen from Taita Taveta be an endless enticing dangling carrot for donation tocken since 2002?? Where is justice?? Who is fooling who?? We must account for School Funding that were embezzled under Prof. Ongeri's leadership and make public how the same funds were paid in full back to UK source of funding sneakily without proper legal explanation to public. We believe that huge Draught funds and Loans disbursed from World Bank with other United Nations Agencies including other value added finances from other different Governments respective MoUs support in Kinds were meant to improve the Education programs in Kenya, Eradicate Poverty, reduce environment pollution and make people's lives better through Partnership Development Program in areas such like in Isiolo, Garissa, Garsen, Wajir, Tana River, Turkana, Lamu, Kwale, Kilifi, Mombasa, Taita Tavetta as well as the Greater Region in and around Lake Victoria, Osienala project and Migingo with other oil producing areas including natural minerals like Titanium, Gold, Diamond, Zinc, Iron-Ore with those rare electronic and computer raw materials, that these natural resource supply are not Traded unscrupulously but are securely benefiting Government and the People adequately that they must be accounted for to justify the agreement commission and purpose for which the Financial Loans, Funds and Grants they were intended for was accomplished. It is also imperative to make sure public corporations are not dished out to individual special interest, where land Grabbing culprits are prosecuted, where stolen natural resources, water towers and finances are not squandered or are resting somewhere gaining credit in individual people's private accounts. It is now evident that Kimemia and NSIS Director General Michael Gichangi both men clandestinely appointed by Kibaki in total disregard of the Constitituional requirement are conniving to intimidate critical institution of the Chief Justice in the Supreme Court during this process of electioneering. Quote: "Upon landing in Dar es Salaam, I received a telephone call from the Director General of the National Intelligence Service, Major-General Michael Gichangi, apologizing for the (small hiccup) at the airport. Told the DG that a Chief Justice being gratuitously stopped by anybody from travelling cannot fit the definition of a small hiccup, however generous one may want to be" Question arises therefore, on what basis would NSIS Director offer an apology on behalf of the head of public service on a matter totally unrelated to his line of duty? We also understand that Francis Kimemia through the illicit unconstitutional self-appointing a position was created for him. This is why he was hand-picked by Kibaki as the Government's Head of Civil Service. Many people know that Mr. Kimemia's appointment is questionable that he was not vetted or scrutinized under Reform Change policy rule through Integrity examination for clearance and in many ways was seen prepared in a careful strategic way to serve the outgoing President Kibaki's interest which resulted in him hijacking to head the Transitional Caretaker Committee in an orthodox unjustified old fashion and making the Committee Team his prerogative.

It must be noted and be made very clear that it is crucial with serious consequence for Kenya to allow itself to be ruled by Suspects who have cases pending at ICC Hague or any leadership that belong to Membership network of the corrupt or gang of terrorists who do not value the Reform Change or respect the Will of the Peoples choices, but use force with threats and intimidation to force their way in leadership.

Kenya must not allow to be forced in any way to succumb to any type of pressure of threats or intimidation, which is unconstitutional and is illegal. A Constitutional Democratic and legitimate election is what will carry the day and is the way to go people……..

These are legitimate justified public mandate demands that must go under Responsibility and Integrity examination threshold test before we can trust certification of those seeking to hold public offices. Avoiding the Integrity threshold for checks and balances with proper justified process for a constitutional legitimate Transitional Caretaker Committee Team is failing the Reform Mandate compliance requirement except the imposition is a pre-plan strategy by Kibaki to rig the elections in order to benefit Special Business Interest away from serving the will of the people…….

This rushing behavior of avoiding and scuttling Integrity threshold sensor is unconstitutional and is unacceptable and we know we can do better through the rightful Legal Justice protest……………

The World is watching very carefully and is very keen about all moves and going-ons in Kenya. No one is too powerful to get away with injustices and no one have express ownership to scuttle people's democratic at will or through threats and intimidation. It is an open book that Kibaki have a case to answer for the conflicts of 2007/8 and also engineered hurdles to fail establishment to Gazette Land Commissioners to engage justification resolve of Land Grabbing by defying and not honoring court order which is a serious felony case.

However, the dispute has been logged in good time in order to make the Reform Change election constitutionally legitimate and this will require a deferment of March 3rd Election however difficult it will be. IEBC trust is falling short of its responsibility requirement and has side-tracked compromising in many ways and this cannot justify legitimacy of its commissioning.

Things must be done the right way people………..We cannot continue to give the political corrupt a blank-cheque to continue messing with our lives. The Chinese business in Kenya must also pay for the environmental pollution they have incurred and we cannot accept the political engineering to continue destroying our livelihood and survival causing us tormenting mental torture and nightmares. Wake up people…….Things must change for better……It is the people's power that must demand to change their destiny for better, we must not be taken for a ride !!!!!

This means, with all the irregularities that has been listed and questioned; it is the people's right to demand that March 4th 2013 election must be fully heard and justified in order to clear all flawed unconstitutionality that were unjustly sneaked into the Constitution Policy, those that provided windows for corruption and impunity that are irregular and do not conform to peoples' mandated demands for Reform. We cannot allow old constitution to take precedence in the Reform Train. This Transparency and Accountability; Responsibility with Integrity threshold for clearance cannot be overshadowed and this must be done before elections can go on…………….

This is the Way Forward people……… It is our right and no one should take it away from us………We all must prepare to fight it the hardest and no one has a right to take People Power away from us………..

Every Kenyan; small and big, local and Diaspora, friends and sympathizers; Do your Part, I Do my part and Together we are one, we must be united for common good we hope to share under Reform Change. Our livelihood and survival is sitting on a timed bomb and destiny is threatened because Kenya is sold to the Chinese on a blank cheque……. We must protect our interests to make good and improve our lifestyle ……. this is what we all want !

Where there is Love, there is happiness. Someone who truly love, do no harm but cares and shares in love. In Corruption and Impunity, there is no love. Corruption and Impunity thrives, when you provide it with fodder or when you feed it. It is through man and the love for self that Evil was able to penetrate to destroy nature and mankind. Where there is Evil, Holy Spirit stays way; because, the Spirit of God is peaceful and tender and it does not struggle for space where your being does not provide it with room to take control in order to guide and protect you from the Evil. Life belongs to God and we are the temple of God. In order for God to defeat Evil that has invaded domain to destroy us, we must be willing to give God room to fight on our behalf and our works must be against the Evil one……because, we cannot serve two masters. Evil comes in many different unusual ways; Evil tongue is full of sweet honey with bling-bling where evil will give you promises to fool you, yet the Evil one knows that power is with God, that all good things comes from God, that God is the author who created all that is in the world; when He finished creation, He said, it is good. He allowed Satan to rebel because God was democratic, He had powers to destroy Satan with its influences, but He did not do it ……. so Satan will not give you a chance to enjoy love and peace from God, he will use lies to defraud you from enjoying your gift from God, evils plans for you are not for you to find goodness, but in every way, evil will steal, kill and destroy…….the Devil is a liar; do not believe anything from him. He lied to God himself to steal what belongs to God. He will lie to you the same way. If we believe in the purpose and will of God for creation and Trust in God's promises we shall not go wrong. He will command his Angels to protect us, so that we do not get into any harm nor shall we be destroyed; but we all shall be United at Peace with each other sharing in God's Blessings.

My loving good people of Kenya, we are in the wilderness and the devil is tempting us at the point of our weakness. Yes, we do not have the money because the evil one has stolen from us. We are hungry and thirsty and we are all in dire needs; although we are vulnerable and helpless, we must not give in to the wicked evil ones to destroy us completely because we have Faith and Trust in God's promises and we want to enjoy in the Blessings of God's Love. We must clothe ourselves in the armor of God in affirmation of Faith and overcome the evils wickedness on the 4th of March and we shall be victorious because God shall be on our side.

Without Love, we cannot please God and God will not be in us. Together let us be United and refuse evil's sweet flattery tongue; the evil ones cannot part company from those of their Special Interest, they are indebted, they are bonded for each other because of their shared special interest, they will continue to corrupt their ways to protect each other by all means and the money they use for bribery are public money stolen from public accounts which they know they cannot account for …..which is why they have refused to go through Integrity Test for Checks and Balances. They are stuck in political conspiracy scheme (business as usual) and as days go by, they are widening their scope of systematically pushing people to succumb into their conspiracy theories and making people vulnerable victims of crime, violation and abuse of Human Rights without consequences…….. Why should Kenyans sit pretty allowing evil to scuttle their Reform Change when the progress have been made three-quarter-way; what about our future livelihood and survival??? Will help come to the helpless vulnerable victims who are targets of political engineered conspiracy without victims themselves waking up and making efforts to make the change happen??? If each and everyone will do the right thing; united in Spirit, together we shall win……..Where there is a will there is a way…….

Leaders come and go, why should we make a fool of ourselves when we have tasted the pain and wrath of corruption and impunity that has brought us backwards in the past 50 years that has been coupled with political engineering of land grabbing where many people were forced out of their dwelling homes and were destroyed and killed right before our eyes and their lands and homes grabbed and shared amongst the special business interest networking.

Rigging Allegations Must Not be taken Lightly, it spells repeat of 2007/8 because the Reform Agenda was not complied but changed to suit Political Engineering Loopholes:

The Restore and Build Kenya (RBK) party has waded into the election rigging claims accusing government spokesman Muthui Kariuki of being partisan.

In a statement, RBK presidential running mate Winnie Kaburu accused Mr Kariuki of dividing the country by his response to claims of rigging the elections by the Coalition for Reforms and Democracy (Cord).

"As RBK, we have had concerns about manipulation of the electoral playing field to make certain candidates "preferred candidates".

"But when the government spokesman takes serious allegations casually, the country is left divided, insecure and confused just two weeks to the General Election," she said.

On Sunday, Mr Kariuki termed Cord's allegations that some top government officials were plotting to rig elections in favour of Jubilee alliance as "reckless, irresponsible and immature" and based on a familiar plot.

"But when the government spokesman goes on national TV to counter claims of rigging, we are forced to revisit Raila's allegation on vote rigging."

RBK questioned whether Mr Kariuki had morphed from a government spokesman to that of Jubilee and criticised the government for failing to take charge of the situation by acting as though it were a 'caretaker' government.

"Is this not to endorse Uhuru and Ruto in this presidential race? Is this not to say that the government is working for certain candidates? Is the Government spokesman holding brief for the Jubilee candidates?"

When contacted, Mr Kariuki told the Nation he is a government spokesman, the one Mr Kenyatta "used to serve before he discovered he could make CEO of this country"

"I am not a politician. It is my business to clarify issues and put the record straight on behalf of the government. Let him (Prof Kiyiapi and his party) concentrate on his faltering campaign and leave me to do my job," he told the Nation in a text message.

Since independence, we have always had two groups, one for change and another for status quo with the latter group championing impunity, corruption and tribalism. This country has always been ruled by status quo forces that is why we have some individuals with 500,000 ha and over 80% with no title to any land more than 1 acre. If you see the response of Kimemia or Muthui to Raila it says alot about who has real power or what they think of the PM. We need to elect a new person to clean up this mess that has made our country waste 50 years of independence. Don't you guys see it?

Mr Kariuki, the best you could have done was to deny any knowledge of any rigging plot , then ask for evidence which you would then discredit. To come out the way you did,to disparagingly respond to concerns of rigging is very disheartening. Remember our history of denying claims which later turn out to be very close to truths-Arturs and City Hoppers midnight runs on the eve of last general election.Please avoid comments that border on party activism.

Fellow kenyans,our country will be there whether Kiyapi or Dida is elected next president.

If Eric Mutua Chairman of LSK with some Lawyers called for the prosecution of groups fanning ethnic tension ahead of the March 4 elections. What do they have to say on flawed electoral process with pre-emptive blown comments seen as manipulative interferences by the government spokesman Muthui Kariuki, what shall voters say and how should the law handle such like cases when people's will is not honored……???

For the Kenya we know, what precedence shall become of head of Public Service and Secretary to the Cabinet, if Francis Kimemia is engaging in politics? Whose interest is Kimemia serving? Under which Reform strategy or policy was the Interim Caretaker Committee formed? Who vetted or cleared them???

Unlike previous occupants of the seat, Kimemia has increasingly become more visible in all Government operations. This is flawed and is seen as a pre-planned strategy for rigging the election of March 3rd 2013.

He has been carefully noticeable participating in the controversial appointment of County Commissioners, interference at the National Hospital Insurance Fund, to failing to gazette Members of the National Lands Commission despite a ruling by the Judge, and lately, asking Western diplomats to explain what they mean by "consequences" if International Criminal Court suspects are elected president in the March 4 elections.

Assistant minister for Defence David Musila, who is eyeing the Kitui County gubernatorial position, has now written to IEBC complaining of interference of election process by the Provincial Administration in his county.

Speaking to The Standard On Sunday on the telephone on Saturday Mr Musila said recently Kitui DC summoned all chiefs, assistant chiefs, and village elders to a meeting whose agenda they were not informed before hand. According to Musila, the chiefs were shocked to find his rivals at the meeting.

"The chiefs were informed that they must make sure CORD rivals in Kitui win the elections if they are to get favours from Government," he said. But on Saturday, Mr Kimemia termed as falsehood Musila's claims.

"Musila should give proof. I don't deal with or summon chiefs or DCs or even PCs. The chain of command is explicit," said Kimemia in a text message.

The Law Society of Kenya (LSK) chairman Eric Mutua said the increased cases of ethnic conflicts were worrying and asked security organs to restore peace.

"The Elections Act, IEBC Act, NCIC Act and Penal Code provide punishment for arson, hate speech, causing pre-poll chaos and election offences," Mutua said.

"Arsonists set ablaze several houses in Kuria East District within Migori County following alleged disputes between different clans over the weekend," he added.

Mr Mutua said that arson was a criminal offence and the suspects would generate voter apathy if not charged in court.

"The era of rigging elections is over," said Ahmed Issack Hassan, the chairman of the Independent Electoral and Boundaries Commission.

He was responding to claims by Prime Minister Raila Odinga's campaign manager, Eliud Owayo, that the heads of the military, the intelligence service and the civil service were part of a plot to rig out Mr Odinga.

Mr Hassan advised presidential candidates to focus on persuading voters rather than on making allegations about rigging.

Government Spokesperson Muthui Kariuki, presumably speaking for Chief of Kenya Defence Forces General Julius Karangi, the Director of the National Intelligence Service, Maj Gen Michael Gichangi and the Head of Public Service Francis Kimemia, described Mr Owalo's allegations as "reckless, irresponsible and immature".

Mr Kariuki further said that the claims were a "familiar" strategy to lay false grounds to reject the results of the election in case Cord was defeated.

But Mr Owalo dismissed Mr Kariuki's statement, saying that he had no mandate to speak on behalf of the three.

He said the issues raised by Cord targeted the three as individuals and not as government officials.

"Let Kimemia, Gichangi and Karangi respond to the issues raised in their individual capacities because they are individually accountable for their actions," Mr Owalo said.

And in an interview with the Nation, Mr Hassan said the electoral commission had spent millions of shillings on technology which made it impossible to rig the elections…………..

The Rigistrar has been told to Reveal what's in poll pacts by the Presidential Candidates…… It is people's right for such information to be made public……..

The registrar of political parties has been asked to reveal to the public the contents of electoral pacts signed by politicians.

International Centre for Policy and Conflict (ICPC) accused the registrar, Ms Lucy Ndungu, of trying to deny the electorate the right to access the contents of the agreements.

In a statement sent to newsrooms, ICPC executive director Ngungu Wainaina said such information had huge implications on the country's future and hence the need to make it public.

"This information has huge implications on the future of the electorate and the destiny of our country. Withholding such critical information is therefore unconstitutional," said Mr Wainaina.

However, Ms Ndung'u said no one had so far written to her requesting such information.

Presidential aspirants Prime Minister Raila Odinga, his two deputies Musalia Mudavadi and Uhuru Kenyatta, Vice-President Kalonzo Musyoka and URP leader William Ruto have signed various election pacts in which they spelt out how they would share power should they win the coming elections.

The Commission for the Implementation of the Constitution (CIC) on Monday accused President Mwai Kibaki of ignoring court orders by failing to gazette members of the National Land Commission.

CIC chairman Charles Nyachae said the president is setting a precedent that could lead the country into chaos after the General Election saying parties are likely to fail to use the courts to address any grievances emanating from the electoral process.

Mr Nyachae took issue with the Office of the President for failing to comply with a court order that Kibaki officially appoints the chairperson and members of the National Land Commission (NLC) by February 11.

He said the president was putting the Constitution in jeopardy by failing to comply with a clear court directive.

"This has far reaching consequences particularly in the current context of an imminent election where complete faith in and respect for the Judiciary as a constitutional institution to solve disputes is an absolute imperative," he said while addressing the press at the CIC offices in Nairobi.

Mr Nyachae said there will be election petitions going by recent allegations of rigging and that the failure to obey court orders by the Office of the President may encourage parties to resort to self-help strategies including the perpetration of violence by those in whom the courts do not grant favorable rulings.

He said it is not the first time the Office of the President was refusing to obey a clear court order citing the ruling of the High Court declaring the appointment of County Commissioners unconstitutional as a case in point.

"Disobedience of court orders by the highest office in the land can only erode the confidence Kenyans have in the judiciary. The post-election violence of 2008 was partly caused by parties failing to use the courts to address their grievances because they had no faith in the courts," he said.

He accused people close to the president of misadvising him saying the Lands Minister James Orengo and the Attorney General Prof Githu Muigai have both correctly advised the president to appoint members of the NLC.

"It must be correct to assume therefore that such advice as the president is receiving on these matters must be emanating from elsewhere," he added, saying the president must carry his own constitutional responsibilities or risk legal proceedings being instituted against him for violating the Constitution when his term in office expires.

Kenyans were aware that implementing the constitution would be a challenge. Kibaki is aware of his duties and obligations towards Kenyans. However, he has set a very bad precedence where he ignores court orders and gets away with it. Late last year, he ignored court order and posted County commissioners. He was given the mandate by Kenyans to act on their behalf, failing to follow the law is not an option and I will be among those willing to take a legal action against him when he is long out of the office. Negligence has no defense, let him do the right thing first and avoid trying to explain later why he didn't do it right in the beginning.

It is unimaginable that a PRESIDENT would violate the constitution of his/her country. But it happens in Kenya. And many times, for that matter. This is HIGH TREASON, and should result in trial by court martial, the President being commander-in-chief of the military. The next government should hold Kibaki accountable for violating the constitution, so that no future President should never ever even imagine or dream of violating the Kenyan constitution. No one has a more sacred obligation to obey the constitution than the President.

i am not Kenyan, but i watched the whole debate cose thiz is a role model for all Africa, in my opinion the professor James ole Kiyiapi, RBK and Paul Muite, Safina and some of the new face are seems to be straight forward and the right one. Lawyers condemn threats to CJ

NAIROBI, KENYA: East African lawyers have condemned alleged threats to Chief Justice Willy Mutunga ahead of the General Elections. The threats were in a poison-pen letter signed by unknown individuals claiming to be the outlawed Mungiki sect.
Law Society of Kenya (LSK) Chairman Eric Mutua and East Africa Law Society (EALS) President James Mwamu said the Judiciary cannot be held at ransom by anyone.
"The CJ and the Judiciary cannot be held ransom. We shall ensure that the rule of law reigns supreme and the culprits are brought to book," Mutua said.
He said investigations should be launched into the allegations and the culprits prosecuted before March 4 polls. Mutua said that independence of the Judiciary was envisaged in the Constitution and the CJ could not be held ransom by threats.
Mutua was reacting to allegations by CJ Willy Mutunga over threats he recently received over a ruling on petitions seeking to block Jubilee Presidential candidate Uhuru Kenyatta and William Ruto from the election.
Mwamu called on the National Security and Intelligence Service to investigate the matter. The EALS President also urged the Judiciary to stand strong and resist against retrogressive forces.
"President Kibaki should order thorough investigations over the matter and the suspects be arraigned in court, justice must be seen to be done," Mwamu said.
Mwamu said that the Constitution provided for fundamental rights that catered for every citizen including the CJ.
It has not been established whether the letter came from Mungiki, supporters of the two Jubilee leaders or political rivals using it as a black propaganda attack. Black propaganda is false information that purports to be from a source on one side of a conflict, but is actually from the opposing side. It is typically used to vilify, embarrass or misrepresent a rival.

CHIEF JUSTICE'S STATEMENT ON JUDGES' SECURITY AND ELECTIONS Fellow Kenyans, I have called this press conference to inform the country of two separate but significant events that have occurred in the past one week. I have considered the possible implications of this public statement, but concluded that given the history of this country, such a public disclosure is warranted, necessary, and proper. This statement does not seek to cause alarm but to strengthen the resolve of each and every Kenyan to protect our Constitution, secure our transition, and affirm our future. On Monday, February 18, 2013, as I was sitting in the Judicial Service Commission interviews for the recruitment of the Deputy Chief Justice, my office received a poison-pen letter from the Mungiki Veterans Group/Kenya Sovereignty Defence Squad. The letter, which was dated Wednesday, February 13, 2013, makes all manner of threats against the Judges, ambassadors and my person. It warns against an adversarial ruling on the Presidential and Deputy Presidential candidacy of Uhuru Kenyatta and William Ruto. The letter extols the violent 'exploits' of the Mungiki movement and threatens dire consequences. This letter was posted only a day before my departure to Dar es Salaam, Tanzania, where I had been invited by the Tanzanian Constitution Review Commission to a one-day event to share my thoughts and experiences on Kenya's constitutional experience. I was stopped at the Jomo Kenyatta International Airport (JKIA) by an Immigration Officer, who insisted that I could not travel because I had not been cleared by Mr. Francis Kimemia, the Permanent Secretary, Head of the Public Service, and Secretary to the Cabinet. I told the official that there is no constitutional, statutory, or policy basis or requirement that provided for the Chief Justice of the Republic to seek clearance to travel from the Head of Civil Service or anybody. Further, the said Circular that he was invoking to make this illegal demand and decision did not -- rightly so -- even have the Chief Justice listed among the Public Officials on it. It requires quite some courage, ignorance, or political patronage or a combination of all three for an Immigration officer, on his own motion, to summon the confidence to stop a Chief Justice from traveling, particularly in the face of a nonexistent circular! After much haggling, I did eventually travel. The Immigration Shift Supervisor kept insisting that they were awaiting instructions. However, I still find the insistence on permission from Mr Kimemia bizarre to say the least. Even more baffling was that the Chief Registrar of the Judiciary received a purported 'Clearance to travel"letter by Mr. Kimemia dated February 14, stating '..it has been noted the Chief Justice is travelling to Dar es Salaam, Tanzania'. Upon landing in Dar es Salaam, I received a telephone call from the Director General of the National Intelligence Service, Major-General Michael Gichangi, apologizing for the 'small hiccup' at the airport. I told the DG that a Chief Justice being gratuitously stopped by anybody from traveling cannot fit the definition of a small hiccup, however generous one may want to be. It has never happened on any of my numerous previous trips. I have, therefore, concluded that this is deliberate harassment; and whereas I was keen to have this resolved bureaucratically, I am convinced it is political, and public accountability requires that I make it public. These two incidents evidence a pattern of emerging harassment against my person, the Office of the Chief Justice, and the Judiciary -- especially since no fewer than five (5) Judges have been attacked in the recent past, with some involving gun incidence – as we head into the elections. I, therefore, wish to state as follows: 1. Kenyans have invested heavily in this country's democratization, and this investment has resulted in a new Constitution. This Constitution must be protected and guarded jealously. Threats and intimidation of this nature against the Chief Justice, judges, or any other Kenyan or individual must be resisted actively, and rejected resolutely. I have given most of my life to a better Kenya and if taking it is what will be required to consolidate and secure our democratic gains in this election, or even thereafter, that is a price I am not afraid to pay. 2. I have invested heavily in the past one and a half years in creating a new Judiciary. I have repeatedly given my pledge to the country that the Judiciary will not flinch in interpreting the Constitution as is required, a task we have executed very well. For the 2013 General Election, we have done sufficient ground work to handle both pre- and post-election matters in accordance with the law. On February 28, 2013, we shall hold a special session with all judges of the High Court to give Kenyans a final statement on our preparedness. Therefore, candidates or their supporters -- real or claimed -- should not panic. We shall decide all cases independently, and with scrupulous fidelity to the Constitution and the law. Let no individual, group, candidate, or supporter imagine that cowardly and darkly acts such as these will cower us. We have seen and overcome worse, and we will all soldier on for this country. None will be held hostage by a cabal of retrogrades. 3. The Judiciary has, in a private correspondence, communicated to Mr. Kimemia as to the legal position on the matter of the 'small hiccup' to ensure it never occurs again. 4. I believe that Kenyan security agencies, unless they willfully neglect or refuse to, have the capacity and resources to investigate the sources and partnerships of this threatening letter. To this end, I have this morning sent the letter to the Inspector General of Police, the Director of the Criminal Investigations Department, Director of the National Intelligence Service, and the Director of Public Prosecutions to investigate this matter and give the country a progress report. I am also asking the Inspector General of Police to take the necessary steps to enhance the security of judges and other judicial officers at this time. 5. If anybody, any candidate, any party, any agency, or any other actor thinks that it will bend the ear, mind and resolve of this Chief Justice to do anything that is unconstitutional or illegal, then they are mistaken. On any matter that will come before me or the Supreme Court, I and the Court shall operate strictly within the confines of the Constitution. Intimidation and threats are uninvited guests and will not be hosted in the execution of our mandate. 6. The political class must choose whether, either through direct pronouncements or suggestive behaviour, they want a peaceful, democratic and fair election free from the ring of rigging and intimidation, or whether they want to put the country on a path of violence. Whatever choice the political class and leadership makes, they must remain aware that ultimately, the people of Kenya and the rule of law will triumph. The Judiciary is playing its part in protecting and upholding the Constitution; let Kenyans also do their part. 7. I appeal to Kenyans to hold a peaceful election. It is only by so doing that we shall silence these dark forces of retrogression and also advance our constitutional and democratic promise. My fellow Kenyans, with confidence and tribute to the nation, go and vote for our Constitution. It is the only way to reject those who threaten and proclaim violence as a false choice. Thank you. Vice President Kalonzo Musyoka has called for thorough investigations into claims that Chief Justice Willy Mutunga has received threats.

Mr Musyoka said the claims were serious and the truth must be established.

The Vice President made the remarks at Matiliku town during his two-day campaign tour of Makueni County.

He said the Chief Justice has done lot to institute judicial reforms and should be allowed to discharge his work without threats or interference.

Mr Musyoka who is on a campaign tour of the Coalition for Reforms and Democracy (Cord) in Ukambani also addressed rallies at Kambu, Makindu, Kasikeu, Nunguni, Mbumbuni, Kikima and Muumandu in Makueni County.

The Vice President who is Raila Odinga's running mate was accompanied by Minister Mutula Kilonzo, Assistant Minister Gideon Ndambuki, former MPs Phillip Kaloki, Isaac Muoki and Kalembe Ndile, Kivutha Kibwana and several candidates for various positions.

He urged Kenyans to elect a Cord government if they want the country transformed.

Mr Musyoka said Kenyans cannot afford to gamble with their lives by voting in leaders who are not committed to the full implementation of the Constitution.

"The new Constitution you passed will enable the Cord government, if elected, to establish irrigation projects in arid and semi arid areas to enable all Kenyans be food sufficient," he said.

He said ASAL areas have depended on relief food for a long time but this would change once Cord captures power.
Mr Musyoka said he was sure the international community was comfortable with a Cord government and would work with it to improve Kenyans' welfare.

He said that in order to eradicate poverty and unemployment challenges facing the country, Cord has a provision in its manifesto for giving youth grants to start businesses.

Chief Justice Willy Mutunga has said the Judiciary will not be cowed by alleged threats from a proscribed sect warning of dire consequences if Uhuru Kenyatta and William Ruto are blocked from contesting the General Election.

Dr Mutunga said the Mungiki sect had written a letter threatening action against judges and himself if the court ruled against the two leaders in an eligibility case.

Civil Society groups had filed a case challenging the eligibility of Mr Kenyatta and Mr Ruto to run for office saying the International Criminal Court (ICC) had indicted them for serious crimes against humanity.

Dr Mutunga said he had received a "poison-pen letter" from the Mungiki Veterans Groups/Kenya Sovereignty Defence Squad making all manner of threats against judges, ambassadors and himself.

Speaking in Eldama Ravine in Baringo County, Jubilee presidential running mate William Ruto said the alliance had confidence in Dr Mutunga and the Judiciary.

"We (Jubilee presidential candidate Uhuru Kenyatta and I) have confidence in you and the reformed Judiciary and you must not succumb to threats," Mr Ruto told the CJ.

"We have been threatened by wazungu (Whites) but we never succumbed because we believe in the rule of law," he said.

Mr Ruto said if Dr Mutunga had been intimidated, the government must act decisively and arrest those behind the threats.

Lawyers condemned the threats to the CJ and Judiciary just days ahead of the General Election.

"The independence of the Judiciary has come a long way and it cannot be brought to its knees by a proscribed sect," Mr Mwamu said.

"President Kibaki should order thorough investigations over the matter and the suspects be arraigned in court. Justice must be seen to be done."

President Mwai Kibaki has assured the Independent Electoral and Boundaries Commission (IEBC) that the Government will facilitate the immediate take-over of the Bomas of Kenya which is the National Tallying Centre to ensure a smooth operation.
President Kibaki gave the assurance on Wednesday at his Harambee House office during a briefing by the IEBC chairman Ahmed Isaack Hassan and his team on the level of preparedness ahead of the March 4th 2013 polls.
During the meeting, it was agreed that the Bomas of Kenya will be a restricted area and only accredited persons will be allowed within the precincts of the institution.
In his brief, Mr. Hassan told the President that the process of importing ballot papers will be complete by the end of this week.
The IEBC chairman also informed the President that the Commission has met all the Presidential Candidates and Secretary Generals of Parties contesting in the general elections
The chairman further informed the President that a list of candidates qualifying to be aspirants for various positions has been gazetted.
The President was also told that preparations for the Bomas of Kenya as the National Polling Centre are complete and the systems tested to ensure efficient delivery of results.
He thanked the IEBC for it's work and assured the commission that 90,000 security officials will be deployed around the country to ensure peaceful elections.
He also encouraged the IEBC, government institutions and officials, political parties and their members and all candidates for various positions to play their part in ensuring a free and fair election.
The President, once again, called for a peaceful election and exuded confidence that Kenya would have a good election.
In the brief, Mr. Hassan said the Commission was partnering with the government and the private sector to conduct a comprehensive voter education programme through Radio and TV stations.
The chairman further added that the commission had served all aspirants with reminders on operationalization of the electoral Code of conduct, the stipulated campaign time between 7.00 a.m. and 6.00 pm and the end of the campaign period which expires on 2nd march, 24 hours before the Election Day.
On simulation of the electoral process and transmission of results, Mr Hassan noted that the exercise, aimed at educating the public on the Polling Day processes, is scheduled for Sunday 24th February 20, 2013 in one polling station in each of all the 1450 County Assembly Wards.
He said that in accordance with the law, the commission has also gazetted the respective Code to the Counties Constituencies, Assembly Wards and all polling stations.
Mr. Hassan assured Kenyans that the collation and publication of the register was complete and preparations are underway to upload the voter register into the poll book.
In attendance during the meeting were Minister for Finance Njeru Githae, Justice Minister Eugene Wamalwa, Attorney General Githu Muigai, Head of Public Service and Secretary to the Cabinet Mr. Francis Kimemia and Justice PS Mohamed Isahakia.
